The analysis of Benjamin’s text allows to reflect upon the controversial relation between rights and violence, so as it appeared to the German philosopher in the years following First World War: a relationship that was so problematic to the point of questioning the possibility that a law, fatally founded on strength, can access justice. The issue would therefore consist in the ambivalence of a violence as creator of rights which is destined to become a violence that preserves them.
